Access to the elementshome.it (hereinafter referred to as “Website” for the sake of brevity) is subject to the terms and conditions outlined below. By using the Website you unconditionally agree to comply with all the clauses described below.

Information on the processing of data relating to purchase management

Dear User,
pursuant to EU regulation no. 2016/679 (the “Regulation”) we wish to inform you that ELEMENTS S.R.L.S. collects and processes your data for the following purposes:

1) Allow and manage your registration on this website. The legal basis of the processing is the performance of a service upon your request (art. 6, par. 1, letter b of the Regulation); the provision of data is necessary in order to allow you to register on the Site.

2) Manage and execute your orders, whether you have registered or opted for the guest mode, (including the related payment management activities and, where applicable, the management of the home delivery and/or installation service and, where applicable, the pre-sales and post-sales service), as well as – where applicable – the management of ancillary services (for example, management of return procedures and/or storage of the last payment method used to facilitate subsequent purchases). With regard to the delivery service, the same may include the sending of notifications functional to the provision of the delivery services themselves, for example via email and/or SMS. The legal basis of the processing is the execution of a service upon your request (art. 6, par. 1, letter b of the Regulation), as well as the legitimate interest of ELEMENTS S.R.L.S. (art. 6, par. 1, letter f of the Regulation) to improve your experience of using the services offered by it; the provision of data is necessary to be able to follow up on your orders.

3) Respond to any requests for information or assistance sent to us through the appropriate channels.

4) Subject to your specific consent, analysis of your consumer choices (including qualitative and quantitative data on your purchases, those relating to the details of the frequency, quantity, type of purchases, amounts spent and the last payment method used) to adapt the commercial offer as much as possible to your profile and your needs, if necessary also by sharing the related information with third-party online platforms and/or social media managers. The legal basis for the processing is your consent (art. 6, par. 1, letter a of the Regulation), without which your consumer choices cannot be analyzed. With regard to the personal data processed for this purpose, ELEMENTS S.R.L.S. has extended the storage of the same to a period of five years, on the basis of its legitimate interest in carrying out customer profiling activities consistent with the average life of its products/services (art. 6, par. 1, letter f of the Regulation).

5) Subject to your specific consent, direct marketing, to inform you of purchasing opportunities and active promotions of ELEMENTS S.R.L.S. to invite you to join further initiatives with commercial and/or promotional purposes, as well as to inform you of purchasing opportunities and promotions of products and services provided by partner companies of ELEMENTS S.R.L.S., to whom however your data will NOT be communicated/transferred, in the insurance, banking, financial, tourism, publishing, manufacturing, food, industrial, commercial, gas, water, energy supply, rental of goods and services sectors, by sending promotional communications, as well as carrying out market research, invitations to review, through traditional tools (e.g.: paper mail, telephone with operator, etc.) and automated tools (e.g.: e-mail, SMS, etc.) and, if applicable, also through sharing the relevant information with third-party online platforms and/or social media managers. Direct marketing activities include sending communications relating to market research and/or questionnaires on the level of satisfaction and perception of users regarding the products and/or services provided by ELEMENTS S.R.L.S.
The legal basis for the processing is your consent (art. 6, par. 1, letter a of the Regulation), in the absence of which you cannot be involved in initiatives with commercial and/or promotional purposes. With regard to the personal data processed for this purpose, ELEMENTS S.R.L.S. has extended the retention of the same to a period of five years, on the basis of its legitimate interest in carrying out initiatives with commercial and/or promotional purposes consistent with the average life of its products/services (art. 6, par. 1, letter f of the Regulation).

6) Classify you in categories and/or broad groups based on a limited number of your objective characteristics, for the purpose of sending you, subject to your consent to marketing, communications or commercial proposals or invitations to review or market research that are not incompatible with your target. The legal basis for the processing is the legitimate interest of ELEMENTS S.R.L.S. (art. 6, par. 1, lett. f of the Regulation) to promote the carrying out of promotional initiatives that are not incompatible with the i with your target as well as to avoid sending communications or proposals that you may perceive as completely useless or inappropriate to your position. The provision of data for this purpose is optional, but in the absence of it it will not be possible to exclude you from the possible sending of promotional communications, invitations to review, and/or market research incompatible with your position.

7) Send you exclusively by post or email commercial and promotional communications to inform you of purchasing opportunities and/or active offers at ELEMENTS S.R.L.S., without prejudice to the possibility of objecting. The legal basis of the processing is the legitimate interest of ELEMENTS S.R.L.S. to carry out direct marketing actions aimed at selling/advertising products or services similar to those already purchased by the interested party. (art. 6, par. 1, letter f of the Regulation).

8) Fulfil any obligations established by applicable laws, regulations or community legislation, or to satisfy requests from the authorities. The legal basis of the processing is the fulfillment of regulatory obligations (art. 6, par. 1, letter c of the Regulation); the provision of Data for this purpose is necessary pursuant to current legislation, and in its absence you will not be able to use the website.

9) Execution of backup and restore operations of the data included in the ELEMENTS S.R.L.S. database with the support of external providers through an automated backup process of all data in the various company databases both in-house and outsourced/in service. The legal basis of the processing is the legitimate interest of ELEMENTS S.R.L.S. to guarantee its operational continuity and an adequate level of integrity and availability of its information assets (art. 6, par. 1, letter f of the Regulation), as well as compliance with regulatory obligations regarding data security (art. 6, par. 1, letter c of the Regulation); the provision of data for this purpose is optional, but in its absence ELEMENTS S.R.L.S. may not be able to allow you to use the website.

10) Protect the rights and interests of ELEMENTS S.R.L.S. in the context of litigation in court and/or out of court, as well as in administrative proceedings, as well as to carry out ex ante and ex post checks for anti-fraud purposes (for example, in the context of the management of any returns). The legal basis of the processing is the legitimate interest of ELEMENTS S.R.L.S. to exercise and defend its rights and interests in court and/or out of court (art. 6, par. 1, letter f of the Regulation); the provision of data for this purpose is optional, but in its absence ELEMENTS S.R.L.S. may not be able to allow you to use the website.

Type and origin of the data processed

The data collected and processed by the Data Controller are personal data of the interested parties, i.e. information through which a subject can be identified as a natural person (for example: name, surname, date of birth, residence, domicile, e-mail address, telephone number, tax code, delivery address, details relating to the object of the product and service requested, order number, etc.) and may also include financial data and, with prior consent, other information such as, for example, spending habits as well as any additional personal information of yours or third parties (for which you assume the related legal obligations and responsibilities) provided by you when requesting information or assistance. We invite you to be careful not to provide information, known as "Special Categories of Personal Data" (e.g. data relating to health, racial or ethnic origin, political opinions, sexual life or sexual orientation of the person, etc.), unless this is strictly necessary to allow ELEMENTS S.R.L.S. to provide you with the requested assistance.

In the event that you provide us with personal data of third parties (e.g. for the delivery and/or delivery of products to recipients other than you), you guarantee that you are authorised to provide us with such data and therefore undertake to indemnify ELEMENTS S.R.L.S. from any dispute in this regard.

Duration of treatment

The data will be processed in full compliance with the principles of confidentiality, correctness, necessity, relevance, lawfulness and transparency imposed by the Regulation for the time necessary to achieve the purposes for which the data were collected and, in any case, no longer than ten years from their collection for the purposes of providing the service or, in the case of purchase of goods, for the time necessary to execute the contractual conditions relating to the coverage of the legal guarantee. For the analysis of your consumer choices, where authorized by you, your purchases will be examined that have a historical depth of no more than five years. To classify you in categories and/or broad groups based on a limited number of your objective characteristics, for the purpose of sending you, subject to your consent to marketing, communications or commercial proposals or invitations to review or market research that are not incompatible with your target, your data will be retained for 60 days.

The possibility for ELEMENTS S.R.L.S. to retain the data for a further period in the presence of regulatory obligations or if this is necessary to defend the rights and/or interests of ELEMENTS S.R.L.S. in judicial and/or extrajudicial proceedings.

Rights of interested parties

You are granted the rights set forth in Articles 15 and following of the Regulation. At any time, you may ask ELEMENTS S.R.L.S. by calling +39 045 966 6302 or by sending an email to info@elementshome.it or to the “Contact Us” section of the website www.elementshome.it, by independently filling out the form on the website www.elementshome.it
• receive confirmation of the existence of your personal data, know the purposes of the processing or their scope of circulation and access their content;
• update, modify and/or correct your personal data;
• request their cancellation, transformation into anonymous form, blocking of data processed in violation of the law or limitation of processing;
• oppose for legitimate reasons to the processing, including profiling;
• oppose the processing of data for the purpose of sending advertising or direct sales material or for carrying out market research, invitations to review or commercial communication;
• revoke consent, where given, without prejudice to the lawfulness of the processing based on the consent given before the revocation;
• receive a copy of the data provided by you and request that such data be transmitted to another data controller.
If you detect a violation of your rights, you can contact the competent supervisory authority pursuant to art. 77 of the GDPR; furthermore, the possibility of contacting the judicial authority directly remains intact.

The material published and/or reproduced on the Website (including, to list a few but not all the material: information, logos, graphic elements, sounds, images, trademarks, etc., hereinafter referred to as “Information” for the sake of brevity) is of exclusive property of (or granted for use by third parties to) Elements s.r.l.s. . The content of the Website is available for personal use only and not for commercial purposes.

Everything reported on this website, documentation, contents, texts, images, logo, artistic work and graphics are the property of ELEMENTS S.R.L.S., are protected by copyright and intellectual property rights.
It is absolutely forbidden to copy, appropriate, redistribute, reproduce any phrase, product, content or image present on this site because it is the result of the work and intellect of the author himself.

Copying and reproduction of the contents and images in any form is prohibited. Redistribution and publication of the contents and images not expressly authorized by ELEMENTS S.R.L.S. is prohibited.

Enforceability. Applicable law and competent Court

The above mentioned clauses form an integral part of the Website and are governed by Italian Law. If any sections of the clauses hereof are found to be invalid, illegal or ineffective, this shall not affect the validity of the remaining parts, which shall continue to be effective. Any disputes which may arise herefrom shall be referred to the Court of Verona. Elements s.r.l.s. reserves the right however to take legal action to safeguard its rights before judicial authorities in other cities or countries other than Italy.

Terms and conditions concerning the logos of Elements s.r.l.s.

Logos, logotypes, distinguishing marks and trademarks, web pages, screen images or other distinguishing characteristics of Elements s.r.l.s. (“Logos”) represent a valuable asset that Elements s.r.l.s. actively protects. To use the Logos – respecting the provisions hereof – you must have express authorisation form Elements s.r.l.s. (“Authorisation”). Authorisation can be obtained by sending a specific request (“Form”) containing the purpose for which the Logos are required. With the Authorisation, Elements s.r.l.s. grants to the user, free of charge, the non-transferable and non-exclusive right to use the Logos solely and exclusively for the purpose and on the materials specified in the Form.

If there is an existing contract with Elements s.r.l.s. which establishes the use of the Logos you do not need to carry out this authorisation procedure; this procedure is however necessary to request Authorisation for other uses not included in the existing contract. In exception to the above the Logos can be used without the prior written consent of Elements s.r.l.s. only if on the Elements s.r.l.s. website there is a clear and explicit declaration that the Logos can be used without authorisation (e.g. search fields).

In any case, the Logos must be used in compliance with the conditions listed below and in particular:

• only graphic elements approved by Elements s.r.l.s. can be used;
• a declaration clearly stating that the Logos are property of Elements s.r.l.s. must be included in the text;
• the Logos must be clearly distinguished from the surrounding text;

The following operations are forbidden:

• remove, distort or alter in any way and/or under any form even just one single element of the Logos, not in compliance with the criteria defined by Elements s.r.l.s. ;
• copy or imitate the trade dress of Elements s.r.l.s. , including the graphic aspect of the web designs property of Elements s.r.l.s. or the presentation of logos or colour combinations, typographic elements, graphic designs, product icons or images clearly associated with Elements s.r.l.s. ;
• use marks, logotypes, slogans or designs than can be confused with the Logos;
• register the Logos with second level dominion names;
• reproduce the Logos in a manner considered by Elements s.r.l.s. , at its unquestionable judgement, as deceitful, improper, defamatory, illegal, slanderous, disparaging or despicable for Elements s.r.l.s. ;
• display the Logos on any digital, paper or other support in a prominent position or in any case in a position that may deceitfully lead to believe that there is a relationship or affiliation with Elements s.r.l.s. , or a sponsorship or approval by Elements s.r.l.s. ; the display of the Logos in a position that may falsely lead to believe that the contents of the pages are created by Elements s.r.l.s. ;
• display the Logos on any website that contains or visualises contents which are for adults only;
• incorporate the Logos in names of products, services, marks, logotypes or companies.

The rights related to trademark property vary from country to country. Some countries apply severe penal and civil sanctions for the improper use of the registration symbol. Therefore the use of the registration symbol (®) is not recommended in countries in which the trademark is not registered. Elements s.r.l.s. reserves the exclusive right to withdraw or change, at its discretion, the Authorisation and to take legal action against any use which does not comply with the provisions hereof, which breaches any intellectual property right or which does not comply with the laws in force.
